Aktieindkomst
Danish "share income" taxed at 27% (up to DKK 61,000) and 42% above. May apply if prediction markets are classified as financial instruments.
Aktieindkomst ("share income") is a Danish tax category for income from shares, dividends, and certain financial instruments. It has its own progressive tax rates separate from personal income:
- 27% on the first DKK 61,000 (2025, approximately €8,200)
- 42% on amounts above DKK 61,000
Prediction markets and aktieindkomst
Whether prediction market gains qualify as aktieindkomst depends on how SKAT (the Danish tax authority) classifies the contracts. If they are considered financial instruments similar to options or futures, aktieindkomst treatment may apply. Otherwise, gains might fall under kapitalindkomst (capital income) or personlig indkomst (personal income).
Married couples
Unused aktieindkomst allowance can be transferred between spouses, meaning a couple can earn up to DKK 122,000 at the 27% rate before the 42% rate applies.
Example calculation
A single Danish trader earns DKK 100,000 from prediction markets classified as aktieindkomst:
- First DKK 61,000 at 27% = DKK 16,470
- Remaining DKK 39,000 at 42% = DKK 16,380
- Total tax: DKK 32,850 (effective rate: ~32.9%)
Compared to kapitalindkomst treatment at up to 42% on the full amount, aktieindkomst is often more favorable thanks to the lower initial bracket.
Loss treatment
Losses on aktieindkomst (e.g., from losing prediction market positions) can offset gains within the same category. Unused losses can generally be carried forward and offset against future aktieindkomst gains. Net negative aktieindkomst may generate a limited tax credit.
Frequently asked questions
How does SKAT determine whether prediction markets are aktieindkomst or kapitalindkomst?
SKAT has not issued specific guidance on prediction markets. The classification depends on whether the contracts are considered similar to equity derivatives (aktieindkomst) or interest-bearing instruments (kapitalindkomst). Seek professional advice from a Danish statsautoriseret revisor.
Do I report prediction market income through TastSelv or the årsopgørelse?
Both — you declare foreign income via TastSelv (SKAT's self-service platform), and it appears on your årsopgørelse (annual tax assessment). If you miss the deadline, you can correct via an ændringsanmodning (amendment request).
